If you hire us, the relationship and deliverables will be governed by a separate written agreement (proposal, scope of work, or contract). If there is a conflict between that agreement and these Terms, the separate agreement controls for that project.

You confirm you have the right to provide it.

(Third-party link/limitation clauses are typical ToU components. )

To the maximum extent permitted by law, Florian P. Consulting will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising from or related to your use of the Site.

Our total liability for any claim related to the Site will not exceed $100. (Limitation-of-liability and warranty disclaimers are standard risk-allocation clauses in ToU. )

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

You agree to indemnify and hold harmless Florian P. Consulting from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site, violation of these Terms, or infringement of any rights of a third party.

13. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.

Any dispute arising from these Terms or your use of the Site will be resolved exclusively in the state or federal courts located in California, and you consent to that jurisdiction. (Governing-law / venue clauses are a common ToU requirement. )
